Missed my celebration

I ordered a cake and flowers for my sister's birthday and I paid extra for the express delivery so that the order would be delivered within 3 hours, however, each time we contacted the delivery man we were told that he will arrive within 15-20 minutes, and he rarely answers the phone.
The party was over, the guests that I invited to share this special day with me left and we had to drive to a nearby bakery to buy a cake. After that the guests had left and the birthday person went to sleep. I got a message from the delivery man that he will arrive in 20 minutes.
We contacted the customer service, and funny enough, we were told that if we don't receive the order, we will not get a refund, meaning that we must accept the order, and wake up my sister at 1 am to celebrate her birthday that was already over.
