Our database includes all marks in India which are registered, pending, opposed, withdrawn, abandoned, cancelled, deceptively similar, etc. as reflected in the records of the Indian Trade Marks Registry with their current status and we have further devised scores of different permutations and combinations for retrieving a wide variety of information from our said database. Our records can be widely relied upon for conducting an accurate IP due diligence in India. We also provide an in depth brand analysis of all proposed, pending and/or registered trade mark(s) along with all attendant advisory services to overcome hurdles in the smooth registration and effective implementation of trade mark rights in India. We further provide watch and monitoring services for all 01 to 45 classes in India and communicate the relevant information gathered or retrieved from the Trade Marks Registry within 5 working days of its inclusion in the said records.
The Application comprises of three prominent components:
• TM VIGILANCE: This tool serves the users by way of providing 24/7 at-a-glance status check of the trademark, copyright, patent and design portfolio and it is accessible from a variety of platforms. The purpose of such tool is to facilitate each and every facility to the user at one platform and thus, the user can easily access the pending/registered trade mark status and its pending compliances like TM-M, Reply to examination report etc. by one click.
• IP PORTFOLIO MANAGEMENT: The Management tool delivers up-to-date consolidated data of the user's entire Intellectual Property portfolio, from filing of the trademark to registration and post-registration compliances, all of which are updated on a regular basis. Following are the essential features:
• The goal is to improve the quality of the user's portfolio by sending out regular reminders of due dates and the activities to be undertaken.
• The application acts as a legal advisor, providing solutions at critical points in the process, such as choosing and adopting a safe trademark, filing an objection against a similar TM, and so on.
• The application also provides cumulative Similar Trademark reports, which saves a lot of time, resources and effort of the users by avoiding the tedious process of searching for similar trademarks out of thousands trademarks published every week.
• In fact, the app notifies the user about the company's entire IP portfolio, including the number of trademarks that are pending, registered, or in litigation.
• IP INFRINGEMENT: The IP infringement + tool scrutinises the journals published on every week as well as the millions of TM existing in India, with the purpose of prohibiting the infringement of Trademark and provide the consolidated report of the similar trade mark in two stages:
• Pre registration Stage: Trademarks that have been advertised and accepted can be challenged within the statutory period of four months from the date of publication. This programme saves a lot of time and energy for a user because it examines the journals that are updated every week and works on retrieving similar trademarks using various permutations and combinations. As a result, it aids in the maintenance of the trade mark's quality by preventing the registration of any similar trademarks.
• Post Registration Stage: The tool also generates a report of trademarks that have not been opposed during the statutory period of four months and are being processed for registration, as well as trademarks that have already been registered, so that rectification actions can be taken against false adopters and the user's portfolio uniqueness can be preserved.
